In the event of a confirmed lost shipment, MT Elk Inc.’s liability is limited to the replacement of the lost items or a full refund of the purchase price, at MT Elk Inc.’s sole discretion. This section explains how and when your payment is processed and funds are captured.
6.1 Authorization and Capture
When you place an order, your payment method is authorized at the time of checkout. This authorization is a temporary hold on your funds and does not constitute a completed charge. Full payment capture occurs when your order is confirmed and fulfilled for shipment. If your order is cancelled before fulfillment, any authorization hold will be released according to your financial institution’s standard processing times (typically 3–7 business days). (Mont. 6.2 Accepted Payment Methods
MT Elk Inc. accepts the following payment methods through our Shopify-hosted checkout:

6.3 Currency
All prices and transactions are processed in U.S. Dollars (USD). International customers, including Canadian buyers, are responsible for any currency conversion fees charged by their financial institution.
6.4 Payment Clearance Before Shipment
MT Elk Inc. reserves the right to hold shipment of any order until payment has fully cleared and been confirmed by our payment processor. Orders flagged during payment processing may be subject to additional verification before fulfillment. MT Elk Inc. shall not be liable for shipping delays caused by payment verification holds. (Mont. 6.5 Failed or Declined Payments
If your payment is declined or fails to process, your order will not be fulfilled. MT Elk Inc. will notify you via email. You may resubmit your order with a valid payment method. MT Elk Inc. is not responsible for any fees or penalties imposed by your financial institution resulting from a declined transaction.

FRAUD NOTICE: MT Elk Inc. employs automated and manual fraud detection on all orders. Orders that trigger fraud indicators may be cancelled, held for verification, or reported to law enforcement. Attempting to use fraudulent payment information is a criminal offense under Montana and federal law.
7.1 Automated Fraud Screening
All orders are subject to automated fraud screening through our payment processor and order management systems. Fraud screening evaluates factors including, but not limited to: billing and shipping address mismatch, unusual order patterns, high-risk IP addresses, and velocity checks (multiple orders in a short time period). 7.2 Order Verification Holds
If your order is flagged for manual review, MT Elk Inc. may:

7.3 Address Verification
MT Elk Inc. uses Address Verification Service (AVS) checks on all credit and debit card transactions. Orders where the billing address does not match the address on file with the card issuer may be automatically declined or held for review. 7.5 Prohibited Transactions & Fraudulent Payment
Use of stolen, fraudulent, or unauthorized payment instruments to purchase from MT Elk Inc. is strictly prohibited and constitutes a criminal offense. MT Elk Inc. will cooperate fully with law enforcement investigations involving fraudulent transactions and will pursue all available civil remedies against fraudulent purchasers, including recovery of the value of goods shipped, shipping costs, investigation costs, and attorneys’ fees. 7.6 Chargebacks & Payment Disputes
If you believe there is an unauthorized charge or an error with your order, you must contact MT Elk Inc. directly before initiating a chargeback with your financial institution. MT Elk Inc. will make every effort to resolve legitimate billing disputes within 5 business days of receiving your complaint. (Mont. CHARGEBACK POLICY: Filing a chargeback for a valid transaction without first contacting MT Elk Inc. constitutes an abuse of the chargeback process and may be considered fraudulent misrepresentation to your financial institution. MT Elk Inc. will contest all unjustified chargebacks and provide full documentation to the issuing bank. Customers who file unjustified chargebacks may have their accounts permanently banned and may be subject to civil action for recovery of the disputed amount plus costs.

7.7 Refund Processing Timeline
Approved refunds are processed within 5–10 business days of MT Elk Inc.’s approval. Refunds are issued to the original payment method only. MT Elk Inc. is not responsible for delays in refund posting caused by your financial institution’s processing timelines. Refunds issued to credit or debit cards typically take 3–7 additional business days to appear on your statement after MT Elk Inc. initiates the refund. (Mont. 7.8 Sales Tax
MT Elk Inc. collects and remits sales tax in jurisdictions where required by law, including Montana and any states where MT Elk Inc. has established sales tax nexus. Montana does not impose a general sales tax; however, Montana-based purchases may be subject to applicable local taxes. Tax amounts will be calculated and displayed at checkout. (Mont. NOTICE FOR LARGE ORDERS: Orders of $1,000 or more are subject to additional payment verification, processing holds, and regulatory compliance procedures under federal banking and anti-money laundering laws. Fulfillment of large orders may take longer than our standard 24-hour processing window. By placing a large order, you consent to the verification procedures described in this section.
8.1 Extended Processing Time
Orders totaling $1,000 or more are subject to an extended processing hold of up to 3–5 business days to allow for payment clearance, identity verification, and banking compliance review. MT Elk Inc. will not ship large orders until payment has fully cleared and all verification requirements have been satisfied. 8.2 Identity & Payment Verification for Large Orders
For orders of $1,000 or more, MT Elk Inc. reserves the right to require any or all of the following before processing and shipping your order:

8.3 Bank Secrecy Act & Anti-Money Laundering Compliance
MT Elk Inc. and its payment processors are subject to federal financial regulations designed to detect and prevent money laundering, structuring, and other financial crimes. Transactions of $1,000 or more may be subject to enhanced due diligence by our payment processor and banking partners under the Bank Secrecy Act. MT Elk Inc. cooperates fully with all such compliance requirements and may be required to collect additional information about the customer and the nature of the transaction. 8.4 Structuring Prohibition
STRUCTURING WARNING: It is a federal crime to deliberately break up a transaction into smaller amounts to avoid reporting thresholds or MT Elk Inc.’s large-order verification requirements. This practice, known as “structuring,” is prohibited under federal law regardless of whether the underlying funds are from a legitimate source. MT Elk Inc. monitors for structuring patterns across multiple orders and will report suspected structuring activity to federal authorities.
Any person who structures or assists in structuring financial transactions to evade reporting requirements is subject to criminal prosecution and civil penalties under federal law. (31 U.S.C. § 5324 — Structuring Transactions to Evade Reporting Requirement)
8.5 Bulk & Wholesale Orders
Businesses or individuals placing bulk orders of MT Elk Inc. products totaling $1,000 or more for resale or distribution purposes must contact MT Elk Inc. directly prior to placing the order to establish a wholesale account. Bulk orders placed through the standard checkout without prior approval may be cancelled at MT Elk Inc.’s discretion.

8.6 Payment Methods for Large Orders

8.7 Right to Refuse or Cancel Large Orders
MT Elk Inc. reserves the right to refuse, cancel, or refund any large order at its sole discretion, including where: (a) verification requirements cannot be met; (b) the transaction is flagged by our payment processor or banking partner; (c) the order exhibits indicators of fraud, structuring, or money laundering; or (d) fulfillment of the order would place MT Elk Inc. in violation of applicable banking or financial regulations.
